Job Description

Role Scope

Euroclear are recruiting for an exciting position within Euroclear Bank Compliance & Ethics team (C&E)

This position has a functional reporting line to the CEO of the Euroclear Bank Hong Kong Branch ("EBHK") to ensure adequate hierarchical level within the Branch.

This role also has a functional reporting line to the Euroclear Bank Chief Compliance Officer ("EB CCO") or delegate, to ensure EBHK compliance and ethics risks are appropriately identified and assessed.

As Local Compliance Officer, you will be in charge of EBHK’s relationship with local regulators.

This role may also supervise and develop a local compliance team.

Role Overview

Divisional Accountabilities / Responsibilities:

  • accountable to ensure there is an adequate:
    • monitoring of compliance with legal and regulatory rules and
    • compliance and ethics process which gives comfort to Senior Management and the Board that "compliance and ethics" risks are adequately managed
  • overall accountable for the C&E function of EBHK;
  • define the C&E strategy for EBHK in line with the requirements of the Euroclear Group C&E Charter; 
  • ensure an appropriate Compliance and Ethics Framework is in place, which is aligned with the Enterprise Risk Management Framework and Risk Appetite Framework, and that it is functioning effectively across Euroclear Bank; 
  • maintain good and trust based relationship with the local regulators.

Role Responsibilities

Stakeholder Management

  • Build and maintain relationships with EBHK senior management. Attend EBHK Local Management Team and ensure compliance and ethics risks are appropriately considered in determining strategy , business developments and responding to business issues; 
  • Build and maintain a trust based relationship with the Hong Kong Monetary Authority ("HKMA"), understand and address their expectations; 
  • Manage the day-to-day contacts with the HKMA by: 
    • providing appropriate status and assurance reports on the management of compliance and ethics risks and EBHK compliance with regulatory requirements,
    • coordinating efforts and gathering information from internal stakeholders to timely and accurately fulfil our reporting obligations towards the local regulators; 
  • Build and maintain external relationships and monitor local market developments to ensure the C&E Strategy remains appropriate for a Financial Market Infrastructure; 
  • Manage the provision of compliance & ethics services to EBHK in the context of the Shared Service Agreement with Euroclear SA/NV ("ESA"); 
  • Ensure an effective Legal and Regulatory Watch process is in place to identify new and amended compliance and ethics risks;
  • As C&E SPoC for EBHK, identify business developments which give rise to new and amended compliance and ethics risks;
  • Support the 1st Line of Defence, as a change agent, through the provision of advice, assistance, trainings and communications on the assessment of compliance and ethics risks, definition of appropriate policies, controls and procedures and testing of the ongoing operation of controls; 
  • Ensure delivery of the 2nd Line of Defence risk assessments and testing in line with the annual plan; 
  • Support the EB CCO and EBHK Management through the provision of an independent view of the inherent and residual compliance and ethics risks of EBHK and appropriate reports on the findings from C&E activities. 

Innovation & Continuous Improvement

  • Develop and maintain a compliance and ethics risk management maturity model for EBHK and obtain Management buy-in; 
  • Participate in external events and conferences to maintain sector knowledge and detect new trends or techniques which may help EBHK maintain a fit for purpose C&E risk management framework;
  • Support the business Compliance champions in the promotion of a culture of compliance and ethics.

Budget / Financial

  • Develop and manage a view of the medium and long term resources needed in order to appropriately execute the C&E mission for EBHK. Identify where Euroclear Bank, Euroclear Group or external resources are required; 
  • Respect financial budgets.

Planning & Organization

  • Build a risk-based multi-year plan for EBHK that covers all business activities, including business evolutions and innovations and that is in line with the inherent and residual risk view and maturity model;
  • Obtain the approval of the EB CCO and EBHK Local Management Team on the plan and ensure it is appropriately resourced;
  • Report quarterly on the plan to the EB CCO and EBHK Local Management Team . Ensure that they have an understanding of the inherent and residual compliance and ethics risks and how well they are being addressed.

Performance Indicators

  • Within EBHK put in place a permanent monitoring framework to support the ongoing review of the management of compliance and ethics risks;
  • Within C&E: Ensure KPIs related to your activity are developed at the right level of accountability and adequately monitored.

Your Profile

Technical Skills

  • Core experience within the Financial Services Sector; knowledge & experience of working in a Compliance function or similar is key. 
  • You have a good understanding of all of the compliance and ethics domains which impact Euroclear Bank; 
  • You have a proven expertise of interacting with Senior Management and Regulators; 
  • You have a good knowledge of the local regulatory reporting environment; 
  • You are fluent in English. Knowledge of Cantonese is a plus; 
  • You have a good knowledge of Microsoft Office.

  • You are proactive and capable of operating autonomously whilst leveraging available support and tools; 
  • You have an independent mindset, are assertive and can manage challenging internal and external stakeholders; 
  • You are able to articulate your point of view and defend it towards Senior Management;
